What Happens When a CPS Case Is Closed? Records, Findings and Next Steps

If you've just been told your child protective services (CPS) case is closed, you might feel relief, confusion, or both. Closure is usually good news, but it doesn't always mean the same thing. This guide explains what a closed case does and doesn't mean, in plain English.
Short answer: when a CPS case is closed, the agency stops actively investigating or monitoring your family. What happens next depends on the finding recorded at closure. If the allegations were ruled out, your name generally should not go on a state abuse registry, though the agency may keep its file. If abuse or neglect was substantiated, the finding can stay on record and affect some background checks, and you usually have a short window to challenge it.
Why CPS cases close
Cases usually close for one of these reasons:
- The investigation found no abuse or neglect (often called "unfounded", "ruled out" or "unsubstantiated").
- Concerns were found but the child is safe, for example after the family completed services or a safety plan.
- A court case ended, for example after the child was returned home and court supervision ended.
- The agency could not complete the investigation, such as when it couldn't locate the family.
Your closure letter should state the finding. If it doesn't, ask the caseworker or their supervisor in writing.
What changes after closure
- Home visits and required services end, unless a court order says otherwise.
- Any court orders still apply until a judge ends them. A closed CPS investigation doesn't cancel a custody order or protective order.
- The case file is kept by the agency, usually confidentially.
- A substantiated finding may be placed on a registry used for certain background checks, such as jobs working with children.
- A new report can start a new case. The earlier history may be considered.
State examples
Texas
- Registry: under Family Code § 261.002, the Department of Family and Protective Services keeps "a central registry of the names of individuals found by the department to have abused or neglected a child."
- Challenging a finding: § 261.309(c) says a person who disputes the department's determination "may request an administrative review of the findings." It is conducted by an employee not involved in the investigation, who must "sustain, alter, or reverse" the findings, generally within 45 days of the request. The department must remove a name from the registry within 10 business days after a finding is overturned (§ 261.002).
- Confidentiality: § 261.201 makes reports and investigation records confidential, with disclosure only as the law allows, including by court order.

California
- Child Abuse Central Index (CACI): under Penal Code § 11169, agencies send the Department of Justice reports only of cases they have investigated and found substantiated. If a report later proves not substantiated, the department "shall not retain the report." Under § 11170, the index "shall not contain any reports that are determined to be not substantiated."
- Hearing: § 11169(d) gives "any person who is listed on the CACI" the right to a hearing before the agency that requested the listing, though a hearing is denied if a court has already found that the abuse or neglect occurred.
Florida
- Confidentiality: Fla. Stat. § 39.202(1) says all department records about reports of child abandonment, abuse or neglect, including hotline reports, "shall be confidential" and may be disclosed only as the chapter authorizes.
- Access: § 39.202(2) lists who may see the records. The list includes the parent or legal custodian of a child alleged to have been abused or neglected, the person alleged to have caused the abuse or neglect, and a court that finds access necessary to decide an issue before it. The reporter's identity is protected separately.
What you can do now
- Keep the closure letter and any notice of the finding.
- Check the finding. If it's substantiated and you disagree, ask how to request a review or hearing and note the deadline.
- Request your records if you need them, using your state agency's records request process.
- Keep following any court orders until a judge ends them.

Does a closed CPS case mean I was cleared?
Not necessarily. A case can close after the allegations were ruled out, after services were completed, or with a finding that abuse or neglect occurred. Read the closure letter: the finding (or disposition) matters more than the fact that the case closed.
Does a closed CPS case stay on my record?
The agency usually keeps its case file, and federal law lets agencies keep information on unsubstantiated reports in casework files for future risk assessments. What matters for jobs and background checks is whether you are listed on a state registry, which generally happens only after a substantiated finding.
Can a closed CPS case be reopened?
A new report can lead to a new investigation at any time, and the agency can consider the earlier history. A closed case doesn't protect a family from future involvement if new concerns arise.
How do I challenge a CPS finding against me?
Most states offer an administrative review or hearing. In Texas, a person who disputes the finding may request an administrative review under Family Code § 261.309(c). In California, a person listed on the Child Abuse Central Index has the right to a hearing under Penal Code § 11169(d). Deadlines are short, so act quickly.
Can anyone see my CPS records?
CPS records are generally confidential. Texas and Florida statutes, for example, make abuse and neglect reports and investigation records confidential, with limited exceptions such as court-ordered disclosure.
